Regulatory position

Regulations and applicability

The rules below do different jobs. Some are enforceable sector requirements, some establish the DPP architecture, and some announce future product measures. Each card explains the distinction.

Current requirement01

Regulation (EU) 2023/1115 on deforestation-free products

What it covers
The EU Deforestation Regulation covers specified products made from cattle, cocoa, coffee, oil palm, rubber, soya and wood when listed in Annex I.
What it means for the record
For an in-scope product, preserve commodity, geolocation, production-date, supplier, risk-assessment and due-diligence-statement links at the relevant lot or shipment level.
Related sector rule02

Regulation (EU) 2023/988 (General Product Safety)

What it covers
General product-safety duties can apply to relevant consumer products, but agriculture has no single universal passport rule.
What it means for the record
Determine the exact commodity and processed product first; never infer EUDR or DPP scope from the word 'agriculture' alone.

Questions teams ask

Does ESPR automatically require farm-product passports?

No. Scope depends on the product and applicable EU legislation. Do not infer a universal obligation from a generic category pack.

What data structure should a Agriculture passport use?

Organize at least four governed blocks: Commodity, origin and producer identity; Plot, facility or batch references; Inputs, production method and certifications; Processing and chain-of-custody events. Every value should retain its source, effective date, product level and review status.

Which evidence should support the Agriculture passport?

The evidence file should cover Producer and origin declarations; Certification and audit reports; Transaction and custody records; Test, residue or quality reports. A public view can cite approved evidence without exposing restricted files or confidential data.
