Regulatory position

Regulations and applicability

The rules below do different jobs. Some are enforceable sector requirements, some establish the DPP architecture, and some announce future product measures. Each card explains the distinction.

Current requirement01

Regulation (EC) No 1935/2004 (food-contact materials)

What it covers
The framework regulation applies to materials and articles intended to contact food and requires safety plus traceability through manufacture, processing and distribution.
What it means for the record
Connect intended conditions of use, declarations, migration evidence and one-step-forward/one-step-back traceability to the exact material or article.
Related sector rule02

Regulation (EU) 2023/988 (General Product Safety)

What it covers
The General Product Safety Regulation can remain relevant to consumer-facing safety aspects not displaced by specific food-contact rules.
What it means for the record
Keep responsible-person and incident data distinct from migration and composition evidence so each rule is supported by the right source.

Questions teams ask

Is a DPP the same as a declaration of compliance?

No. A passport can reference and present approved data from a declaration, but it does not replace the underlying legal document.

What data structure should a Food-contact materials passport use?

Organize at least four governed blocks: Material and article identity; Intended food types, temperature and contact duration; Composition and applicable restrictions; Batch, manufacturer and supply-chain traceability. Every value should retain its source, effective date, product level and review status.

Which evidence should support the Food-contact materials passport?

The evidence file should cover Declarations of compliance; Migration and analytical test reports; Supplier specifications; Good manufacturing practice records. A public view can cite approved evidence without exposing restricted files or confidential data.
